Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Should I? mobile application and website at shouldi.fun, operated by The Should I Team ("Company", "we", "our"). By accessing or using Should I?, you agree to be bound by these Terms. If you do not agree, do not use the app or website.
1. Acceptance of Terms
By downloading, installing, or using Should I? in any way, you confirm that you are at least 17 years old (the minimum age for the app as listed on the Apple App Store and Google Play Store) and that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
We reserve the right to update these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of Should I? after changes are posted constitutes your acceptance of the updated Terms.
2. Use of the Service
Should I? provides an anonymous polling platform where users can post questions, vote on questions posted by others, and leave short text comments ("Takes"). You may use the service without creating an account. An optional Google Sign-In is available for users who want to manage their content across devices.
You agree to use Should I? only for lawful purposes and in a manner consistent with these Terms. You are responsible for all content you post.
3. User Conduct
You agree NOT to post, submit, or share content that:
- Is illegal, threatening, harassing, defamatory, or abusive
- Is sexually explicit or pornographic
- Targets, identifies, or exposes any individual without their consent
- Promotes self-harm, suicide, or eating disorders
- Constitutes hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Infringes any third-party intellectual property, privacy, or other rights
- Is spam, automated bot-generated content, or deliberate vote manipulation
- Contains malware, phishing links, or other malicious code
We use automated filters and human moderation to enforce these rules. Violations may result in content removal, a device ban, or legal action without prior notice.
Should I? includes mental health safeguards. Content that triggers our mental health filters will be blocked and the user will be shown crisis resources. This policy is non-negotiable.
4. Content Ownership and License
Your content
You retain ownership of the questions and Takes you post. By submitting content to Should I?, you grant us a worldwide, royalty-free, non-exclusive license to display, distribute, and reproduce that content within the app, on our website, and in share cards generated from your question. This license ends when your content is deleted.
Anonymity and public visibility
All questions and Takes are posted anonymously. Your Device ID or account identity is not displayed publicly. However, because questions are public by design, you should not post content that you consider private.
Our content
All other content on Should I? — including the interface, design, brand, logo, and underlying code — is owned by the Company and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
5. Prohibited Content
In addition to the conduct rules above, the following content categories are expressly prohibited and will be removed immediately:
- Content that identifies, doxxes, or exposes private individuals
- Content involving minors in a sexual or harmful context
- Calls to violence against specific persons or groups
- Content that is illegal under the laws of Benin or applicable international law
We maintain a list of banned keywords and phrases that are automatically blocked. Circumventing these filters is itself a violation of these Terms.
6. Moderation and Account Actions
We reserve the right, at our sole discretion and without notice, to:
- Remove any content that violates these Terms or that we find objectionable
- Temporarily or permanently ban any device or account
- Cooperate with law enforcement authorities when legally required

7. Disclaimer of Warranties
Should I? is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, secure, or free of viruses. We make no warranty regarding the accuracy, reliability, or completeness of any content on the platform — including user-generated questions and votes.
8. Limitation of Liability
To the maximum extent permitted by applicable law, the Company and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) Should I?.
Our total liability to you for any claim arising out of these Terms or your use of Should I? shall not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim or (b) USD 10.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Benin, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of Should I? shall be subject to the exclusive jurisdiction of the competent courts of Benin.
If you are accessing Should I? from the European Union, you may also have rights under applicable EU consumer protection law. Nothing in these Terms affects your statutory rights under applicable mandatory local law.
